Obama team ready for full-court press
As the new presidential administration is becoming increasingly loaded with good basketball players, Barack Obama has stressed that hardcourt skills are not a requirement for service.
“I did not pick Arne because he’s one of the best basketball players I know,” Obama said Tuesday in announcing the selection of Arne Duncan as the new secretary of education.

As Mark Memmott notes in USA Today, it is fair to say that the Obama and his appointees got game. (Full disclosure: Memmott is this writer’s brother.)
Obama was a reserve on the Punahou High School team that won a state championship in Hawaii in 1979. He didn’t play in college, but he continues to take part in pick-up games.
A You Tube video from April shows then-candidate Obama in a three-on-three game at an Indiana high school.
A left-handed point guard, the 6-foot-2 Obama makes several good moves to the basket, all of which are enthusiastically celebrated by announcer Herbie Ziskend of the Obama staff. No ball hog, Obama also gets off some good passes.
Obama’s talents aside, Duncan, currently the CEO of the Chicago public schools, might be the star of the cabinet team.
A co-captain of the 1986-1987 Harvard basketball team, the 6-foot-5 Duncan went on to play two seasons for the Eastside Spectres in Australia’s National Basketball League, averaging 26 points per game, according to league records.
The rest of Obama’s starting five could include:
- James L. Jones Jr., a retired Marine General, chosen to be national security adviser. He played forward for Georgetown University, graduating in 1966.
- Susan Rice, a former point guard at National Cathedral School in Washington who is slated to be the U.S. ambassador to the United Nations.
- Eric H. Holder Jr., the nominee for attorney general, who co-captained a losing team at academically prestigious Stuyvesant High School in New York City in the late 1960s.
Should any of these players tire, Obama could bring in Reggie Love, his 6-foot-5 personal aide. Love played football at Duke University and was a reserve on the 2001 NCAA championship basketball team.
Love offered this analysis of his boss’ game to The New York Times: “He’s quick and he’s strong. A lot of people still don’t know that he’s left-handed, so he can get to the basket and get his shot off, even though he’s not the most explosive or tallest player on the court.”
Timothy Geithner, the pick for Treasury secretary, also might have a spot with the Obama five, as he’s said to be a pick-up game regular.
Reaching beyond his appointees and staff, Obama could suit up fundraiser John W. Rogers Jr., the 1979-80 Princeton co-captain and head of Ariel Capital Management.
Martin Nesbitt, another fundraiser, is also a regular in Obama’s pick-up games.
Obama’s court closer could be Craig Robinson, his brother-in-law. The coach of the Oregon State University men’s basketball team, Robinson starred in basketball at Princeton University.
Michelle Robinson Obama noted at the Democratic Convention this summer, that when Barack Obama was wooing her, Craig Robinson vetted the young lawyer on the basketball court.

Schapiro likely to be questioned about Madoff tiesDecember 19, 2008 at 11:30am
Mary L. Schapiro, Barack Obama’s pick to head the Securities and Exchange Commission, is being described as the right person to help restore the commission’s battered reputation.
“If there is anybody who is going to reinvigorate the SEC, it is Mary,” David M. Becker, the commission’s former general counsel, told The Washington Post. “I have no doubt that with her leading the SEC, it will show its teeth whenever necessary.”
Saudia Arabia, Norway, Kuwait donated millions to Clinton charity
Former President Bill Clinton has revealed tens of millions in donations to his foundation from foreign nations that Hillary Rodham Clinton may have to negotiate with as secretary of state.
Saudi Arabia was the most generous nation, giving between $10 million and $25 million, according to the list published today on the foundation’s Web site. (A warning: the site was crippled by high traffic throughout the day.)

Clinton Foundation gave more than $25 million: the Children’s Investment Fund Foundation, dedicated to relieving poverty for children in developing countries, and the disease relief group, UNITAID.
Norway donated $5 million to $10 million; Kuwait, Qatar, Oman and Brunei all contributed between $1 million and $5 million, as did the Taiwan Economic and Cultural Office. The Dutch national lottery gave between $5 million and $10 million. An Irish government aid program gave at least $500,000.
All told, the Foundation raised more than $500 million from more than 200,000 donors for humanitarian projects around the world and the construction of the presidential library in Little Rock, Arkansas. Besides numerous foreign governments, the list includes companies and individuals who might have an interest in United States foreign policy.
One of the leading private donors is Amar Singh, an Indian politician. Singh met with Senator Clinton in September while on a trip to Washington to lobby for a controversial agreement for India to obtain civilian nuclear technology from the United States.
An Indian business association, the Confederation of Indian Industry, also donated between $500,000 and $1 million.
Among the biggest contributors overall are the Bill & Melinda Gates Foundation, an overseas aid program by the Australian government and a Dominican Republic agency dedicated to combatting AIDS. All three gave between $10 million and $25 million.
Donors in the $10 to $25-million range include:
- Stephen L. Bing, a Los Angeles entertainment producer who was a Clinton fund-raiser during the presidential campaign and who also gave more than $4.8 million to liberal groups involved in the elections.
- Fred Eychaner, a Chicago media mogul.
- Theodore W. Waitt, co-founder of the Gateway computer company.
- Tom Golisano, founder of the Paychex payroll processing company in suburban Rochester, NY. Golisano also donated $1 million to the host committee for this year’s Democratic convention, and financed his own campaigns three times for New York governor.
- Frank Giustra, a Canadian merchant banker who finances mining ventures. Giustra flew Clinton to Kazakhstan in 2005 aboard his private jet as the former president was soliciting donations for his foundation. Clinton praised Kazakhstan’s authoritarian president, Nursultan Nazarbayev, and Giustra later entered agreements to invest in government-controlled uranium projects there.
The contributions also include $250,000 to $500,000 from Denise Rich, whose husband Marc Rich received a controversial pardon from Clinton in his final hours in the White House.
Former securities lawyer William Lerach, who is now serving two years in federal prison for his role in a kickback scheme, gave between $100,000 and $250,000.
Even Richard Mellon Scaife, a Pittsburgh media titan who helped finance efforts to discredit Clinton during his presidency, gave $100,000 to $250,000.
Federal law does not require a former president to reveal his foundation’s financial benefactors, and Clinton had declined to do so until now.
But when Obama asked Hillary Clinton to join his cabinet, the former president agreed to release his list as part of a nine-point agreement intended to keep his activities from compromising his wife’s work as the nation’s top diplomat.
The list released on Thursday does not detail the precise amounts of the donations, nor the dates they were given, instead breaking down contributors by general dollar ranges.

Top Madoff players hire lawyers with ties to SEC, Justice department
Key players at Bernard L. Madoff Investment Securities Inc. have hired some of the best-connected lawyers in the business.
Madoff’s attorney is Ira Sorkin, who once headed the New York office of the U.S. Securities and Exchange Commission and who also worked as a federal prosecutor in New York.

He also speaks on topics such as “Coordinating a Response to Allegations of Financial Fraud,” according to his page on the firm’s website.
Frank DiPascali, Madoff’s chief financial officer, is represented by Marc Mukasey, the leader in the white collar criminal defense practice of Bracewell and Giuliani and stepson of U.S. Attorney General Michael Mukasey.
While DiPascali has not been charged, he has been described as a key figure in the separate staff that worked closely with Bernard Madoff on the 17th floor of the firm’s office at the Third Avenue building known as the Lipstick Tower. That operation, which is believed to have orchestrated Madoff’s alleged $50-billion Ponzi scheme, had its own computer systems, and did not process its trades through the Madoff firm.
The junior Mukasey has declined to say whether DiPascali is a target of investigators. But he, too, brings considerable strengths as a defense attorney: He worked for eight years as an assistant federal prosecutor; before that, he was a staff attorney for the SEC prosecuting securities fraud, according to his staff bio.
The elder Mukasey recused himself from the case yesterday, citing conflicts of interest because of his son’s role. In addition, Michael Mukasey is a 1959 graduate of the Ramaz School, a modern Orthodox Jewish school in New York that invested as much as $6 million in a fund that was a Madoff client, said Kenny Rochlin, Ramaz’s director of institutional advancement.
Madoff’s sons, Andrew and Mark, who first reported their father after he purportedly confessed to defrauding investors, have retained Martin Flumenbaum, senior partner in the litigation department of Paul, Weiss, Rifkind, Wharton & Garrison.
Flumenbaum is considered one of the nation’s top litigators, representing Hollinger International and American International Group Inc., among other deep-pocketed clients.
He is also a former assistant federal prosecutor who led the successful tax prosecution of Sun Myung Moon in 1982, according to the biography posted on his firm’s site.

Another fixture of the Clinton administration is helping Barack Obama make his move from senator to president.
The New York Times reports that Betty Currie, Bill Clinton’s secretary for his eight years in office, is volunteering at the offices of the Obama-Biden transition team.

Podesta, the transition co-chairman, who also served in the Clinton White House, finishing up as chief of staff.
“Of course I asked her because in the 30 years we have worked together, I have never known anyone with more grace, dedication and public spirit than Betty,” Podesta told the Times. “And she has one mean Rolodex.”
The paper did not report whether Monica S. Lewinsky’s name remains in that Rolodex.
In 1998, Currie had to appear five times before the grand jury investigating the relationship between Clinton and Lewinsky.
After her testimony became public, some people faulted her for possibly enabling the relationship between the president and the young intern, adopting a “don’t ask, don’t tell” stance.
Others, though, saw her as yet another victim of Clinton’s recklessness.
“She didn’t deserve this – at all,” a co-worker told The Washington Post at the time. “She’s not a villain by any stretch of the imagination.”
Currie, 69, came to the White House after serving as the office manager of the “War Room” during the 1992 Clinton presidential campaign.
The room was the place where James Carville, George Stephanopoulos and other Clinton advisers planned strategy.
Currie also worked on the Clinton-Gore transition team.
And she took part in the 1988 Michael Dukakis presidential campaign and the 1984 Walter Mondale campaign.
Previous to this, Currie had been an executive assistant and personal secretary in several federal agencies, including the U.S. Peace Corps and ACTION, the umbrella agency over the Peace Corps.
During this time, she was the executive secretary for three directors, Joseph Blatchford at the Peace Corps and ACTION and Michael Balzano and Sam W. Brown Jr. at ACTION.
Currie retired from the federal government at the end of Clinton’s second term.
In 2006, she became a member of the board of National Peace Corps Association. She recently became a member of the Alcohol Beverage Board of St. Mary’s County, MD.
She and her husband, Bob, a retired Environmental Protection Agency planning director, took Socks, the Clinton’s White House cat, into their home at the end of Clinton presidency.
The cat is now 19 and reportedly has cancer.
Currie remains in contact with the Clintons, the Times reported, and contributed $750 to Hillary Clinton’s presidential campaign.

Saudia Arabia, Norway, Kuwait donated millions to Clinton charityDecember 18, 2008 at 6:37pm
Former President Bill Clinton has revealed tens of millions in donations to his foundation from foreign nations that Hillary Rodham Clinton may have to negotiate with as secretary of state.
J. Ezra Merkin helps wipe out father’s legacy
It is a tragedy of almost Biblical dimensions: The late Hermann Merkin was a lion of Jewish philanthropy who gave millions to help build Yeshiva University, the Fifth Avenue Synagogue and Merkin Concert Hall, among other causes.
His son, J. Ezra Merkin, who took his father’s place as a director of many of those institutions, has managed to wipe out much of what Hermann Merkin spent a lifetime creating.

Please go here to check for the latest version of Java.Ezra Merkin was “the Golden Boy controlling the Golden Goose,” as one trustee at Yeshiva University put it – the head of Gabriel Capital Group, a $5 billion money-management firm whose clients include wealthy families and university endowments. So it was not surprising that many institutions turned to him to help manage their endowments.
Merkin invested their money in a $1.8 billion fund he called Ascot Partners – telling no one that Ascot was invested entirely with his longtime friend, Bernard Madoff, the Wall Street trader accused last Thursday of defrauding investors through a $50 billion Ponzi scheme.
Now, all that money is presumed gone.
In a three-paragraph note sent out the day that Madoff was arrested, Merkin informed Ascot’s investors that the fund was now virtually worthless. He said he himself had “suffered major losses from this catastrophe.”
That was little consolation, however, to Hebrew University, said to have lost $110 million of its endowment; or to Congregation Kehilath Jeshurun, the Ramaz School of Manhattan and SAR Academy in Riverdale, said to have lost substantial sums; or to several family foundations belonging to Merkin’s fellow trustees at Yeshiva University, including Robert M. Beren and Ludwig Bravmann.
Another Ascot casualty was a charitable trust founded by real-estate magnate Mortimer Zuckerman, the chairman of real-estate firm Boston Properties and owner of the New York Daily News and U.S. News & World Report. That lost $30 million.
Harry Susman of Houston law firm Susman Godfrey LLP, who has been retained by several well-to-do New York families, told the New York Times that none of those investors knew Merkin was giving all of the money to Madoff.
He said his clients are particularly incensed because Merkin was charging them an annual fee of 1.5 percent of their investments in exchange for his services, which now appear to be little more than turning over the money to another investor.
“People who went through Merkin, they had to pay for the privilege of being stolen from,” Susman said.
Indeed, even as he has portrayed himself as a victim, Merkin is being harshly criticized. Several people told Jewish Week that while they had been reluctant to invest with Madoff, they trusted Merkin completely.
“We thought we were investing in Ezra,” said one official of a Jewish institution, “and now find out we were invested with Madoff. We feel duped and outraged.”
One private investor said that several years ago he asked Merkin directly if his investment in Ascot was going into the Madoff fund and was told it was not.
…Merkin has served for the last several years as chairman of the investment committee at UJA-Federation of New York. But in part because the federation has a policy prohibiting members of the committee from directing funds, there was no exposure of its funds to Ascot Partners or Madoff.
“There were some on the board who grumbled about us missing out on a solid investment but we weathered the criticism,” one insider noted.
Merkin is expected to be off the UJA-Federation board by week’s end.
Yesterday, the first of what is expected to be a slew of investor lawsuits against Merkin was brought by New York Law School, which had invested $3 million in Ascot Partners.
The lawsuit, filed in U.S. District Court in Manhattan, alleges recklessness, gross negligence and breach of fiduciary duties by Merkin, the fund, Ascot Partners and its auditor, BDO Seidman LLP.
Merkin’s lawyer, Andrew J. Levander, offered this response:
“Mr. Merkin and his family are personally among the largest victims of the massive fraud confessed by Bernard Madoff. Like the other victims and the entire financial community, Mr. Merkin is shocked by these events. He intends to defend the lawsuit vigorously while seeking redress for himself and his investors from whoever perpetrated this fraud.”

Education nominee Arne Duncan gets some help from his friends
They say it’s not what you know, but who you know.
In the case of Chicago Schools Chief Arne Duncan, tapped today to be President-elect Barack Obama’s Education Secretary, you couldn’t have a more powerful network in your corner.

All apparently helped him beat out the other top contenders for the education post, including New York City Schools Chief Joel Klein and Linda Darling-Hammond, a Stanford University education professor.
Not that Duncan, 44, who leads the nation’s third-largest school system, doesn’t have arguments on the merits.
Since Chicago Mayor Richard Daley picked him to head the city school district in 2001, he has gained a reputation as a reformer who isn’t afraid to challenge the teachers union and close underperforming schools. Public school students have gotten higher test scores on his watch, although they still lag behind the Illinois average.
He has also supported charter schools, performance pay-plans and other steps to shake up the status quo, including paying students for good grades.
“Chicago’s loss is the nation’s gain,” the Chicago Sun-Times declared today, touting Duncan’s efforts to shut down dozens of failing schools and replace them with 100 new ones.
Duncan, who grew up in Hyde Park where the Obamas now live, has been friends with Obama for years, advising him on education policy.
After graduating magna cum laude from Harvard in 1987 with a major in sociology, the 6-foot 5-inch tall Duncan bombed a tryout with the Boston Celtics, then moved to Australia for several years to play professional basketball.
He returned to Chicago in 1992 to direct the Ariel Education Initiative, a project sponsored by his friend John Rogers’ company, Ariel Capital Management LLC. The organization seeks to create educational opportunities for inner city kids.
In 1998, he joined the Chicago Public schools, and ascended to the top post three years later.
At a press conference today, Obama praised Duncan’s “deep pragmatism.”
“If charter schools work let’s try that,” Obama said. “Let’s not be clouded by ideology when it comes to figuring out what helps our kids.”
Obama also bragged that “we are putting together the best basketball-playing Cabinet in American history.”
